Leave of Absence

FMLA/CFRA

In compliance with the federal Family and Medical Leave Act (FMLA) and the California Family Rights Act (CFRA), 麻豆社madou provides eligible employees with job-protected leave under the provisions of this policy. Up to twelve (12) weeks of leave is provided within a twelve (12) month period for eligible family and medical reasons, or for qualifying exigencies arising out of a military member鈥檚 covered active duty or an impending call or order to active duty. Employees can be unpaid or elect to use accrued time off. For more information, please see policy 520.

FMLA/CFRA doesn鈥檛 provide income replacement benefits, but you may be eligible for State Disability Insurance (SDI) or Paid Family Leave (PFL), as determined by the Employment Development Department (EDD).听 The 麻豆社madou Payroll Department can integrate/coordinate payments from the EDD with your accrued time off.听 This means if you receive SDI/PFL your accrued time off balances will typically last longer. Please visit the for information about filing a claim. If you choose not to apply online and need a copy of the form please contact the EDD for a current copy of the form.听 Please be advised that SDI/PFL normally replaces only part of the employee鈥檚 pay. Applying for benefits with EDD is not contingent on your leave request being approved under family medical leave.

 

Reasons to apply for leave under FMLA and/or CFRA:

  • Serious Illness or Health Condition
  • Surgery
  • Care for a Spouse, Child or Eligible family member due to their serious illness or health condition
  • Pregnancy FMLA/CRFA/PDL (please see information below)
  • Baby Bonding
  • Paternity Leave

 

Am I Eligible for FMLA/CFRA?

To be eligible for FMLA leave, an employee must have:

  • been employed 1 year and,
  • worked at least 1,250 hours during the 12-month period preceding the start of the leave

Any employee, including a part-time, temporary or who meets the above criteria, would be eligible for FMLA leave, subject to the provisions of this policy and in accordance with the Act.

Other Leaves (time used may overlap with FMLA or CFRA allocation)

  • Pregnancy Disability Leave (PDL) – Provides eligible employees with unpaid, job-protected leave in the event of a pregnancy, childbirth, loss of pregnancy, and/or pregnancy-related physical and mental conditions. Eligible employees may take up four months of leave while disabled by pregnancy.

Duration of employment & hours worked requirement does not apply to this type of leave.

How to Request a Leave

To request FMLA leave, the employee should provide 30 days advance notice if the leave is foreseeable to their manager and the HR department. When a 30-day notice is not possible, the employee should provide notice as soon as possible.
